1. USER INFORMATION
Who is responsible for processing your personal data?
On the Road Colombia SAS is the DATA CONTROLLER responsible for processing the USER's personal data and informs the USER that such data will be processed in accordance with the provisions of Law 1581 of 2012 (Habeas Data), which establishes general provisions regarding habeas data and regulates the handling of information contained in personal databases, particularly financial, credit, commercial, service-related information, and information originating from third countries, as well as other related provisions.
Why do we process your personal data and for what purposes?
Depending on the form through which we have obtained your personal data, we will process it confidentially for the following purposes:
Reservation Form

To formalize reservations with the Data Controller. (For the performance of a contract or pre-contract.)

To send advertising and commercial communications by email, fax, SMS, MMS, social media, or any other electronic or physical means, whether existing or developed in the future, to customers regarding products or services similar to those initially contracted by the customer.
User Registration Form

To manage the user's account in order to provide personalized access to the website and the interactive services it offers.
How long will we retain your personal data?
Your personal data will be retained for no longer than necessary to fulfill the purpose for which it was processed, or for as long as required by applicable legal retention periods. Once the data is no longer necessary for these purposes, it will be deleted using appropriate security measures to ensure its anonymization or complete destruction.
In particular, data relating to contracts will be retained for at least three years from the completion of the service. On The Road Colombia may retain such data for a maximum period of five years where necessary.
Who do we share your personal data with?
No disclosure of personal data to third parties is contemplated, except where necessary for the development and execution of the purposes of the processing, in which case data may be shared with our service providers related to communications, with whom the DATA CONTROLLER has entered into the confidentiality and data processing agreements required by applicable privacy regulations.
These service providers may include technical service providers, legal service providers, or solution providers such as Microsoft.
What are your rights?
In accordance with applicable law, data subjects have the following rights regarding the processing of their personal data:

Right of access: Data subjects have the right to know whether their personal data is being processed and to access or obtain a copy of their personal data.

Right to rectification: Data subjects may request the correction or updating of their personal data when it is inaccurate.

Right to restriction of processing: In certain circumstances, data subjects may request the restriction of the processing of their personal data, in which case we will retain the data only for the establishment, exercise, or defense of legal claims.

Right to object: In certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their personal data. The Data Controller will cease processing the data unless there are compelling legitimate grounds for doing so, or the processing is necessary for the establishment, exercise, or defense of potential legal claims.
Data subjects may also file a complaint with the corresponding authority, the SIC (Superintendencia de Industria y Comercio), if they believe that their data protection rights have been violated.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER
By checking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or provided in download forms, USERS expressly, freely, and unequivocally accept that the requested information is necessary for the service provider to process their request, while providing information in the remaining fields is voluntary. The USER guarantees that the personal data provided to the DATA CONTROLLER is accurate and assumes responsibility for notifying the DATA CONTROLLER of any changes to such information.
The DATA CONTROLLER informs USERS that all information requested through the website is mandatory, as it is necessary to provide an optimal service to the USER. If all requested information is not provided, the DATA CONTROLLER cannot guarantee that the information and services provided will be fully tailored to the USER's needs.
3. SECURITY MEASURES
In accordance with the provisions of the applicable regulations on the protection of personal data, the DATA CONTROLLER complies with all provisions established under the applicable Habeas Data regulations for the processing of the personal data under its responsibility, and expressly complies with the principles set forth in Law 1581 of 2012, under which personal data is processed lawfully, fairly, and transparently in relation to the data subject, and is adequate, relevant, and limited to what is necessary in relation to the purposes for which it is processed.
The DATA CONTROLLER guarantees that it has implemented appropriate technical and organizational policies and measures to comply with the security requirements established under the Habeas Data regulations, with the purpose of protecting the rights and freedoms of USERS, and has provided them with the appropriate information so that they may exercise their rights.
